Promoting Equal Pay-NAAUSA

Throughout the association’s history, NAAUSA has advocated for DOJ reforms that eliminate the significantly lower salaries paid to AUSAs on the Administratively Determined (AD) pay system, compared to their trial attorney counterparts at Main Justice who are on the General Schedule (GS) or Senior Executive Service (SES) pay systems. The unfair and demoralizing pay gap between AUSAs and their Main Justice counterparts is as large as $40,000.

NAAUSA has called on the Attorney General to use existing authority to ensure equal pay for AUSAs. NAAUSA calls on Congress to either move AUSAs onto the GS pay system, or amend 28 U.S. Code § 548 – Salaries to raise the AUSA pay cap from Executive Level IV to Executive Level II, equivalent to the top pay available to Main Justice attorneys.
